This data and software and any accompanying documentation (together 'the System') are Patent Pending and protected by copyright, database right and other intellectual property rights which are owned by or licensed to Divago.com, Inc. ('the Licensor').
1) Licence
(a) The Licensor grants the right to use the System and install the software on any number of computers. The System may be distributed for free without charge or fee of any kind. The end-user may not sell, rent, lease or sub-license any copies of the System or any part of it. Ownership of the System is not transferred to the end-user. Ownership of the copyright, database right and other rights in the System, and any permitted copy of the software made by the end-user, remains vested in the Licensor, subject to the rights granted to the end-user under this Licence. All other rights are reserved. Any copy made will be subject to the terms and conditions of this Licence in all respects and the terms of this Licence, all titles, trade marks, and copyright and restricted rights notices shall be reproduced in such copies.
(b) No part of the System may be adapted, translated, modified, reverse engineered, decompiled, disassembled or reduced into any electronic or other form without the prior written consent of the Licensor.
(c) The Licensor may terminate the end-user right to use the System immediately if s/he fails to comply with these terms.
2) Privacy
Divago expressly covenants not to collect any information on the end-user in any manner whatsoever (use of "cookies" files, registration forms, password, logs files, downloading of tracking software, etcà).
Divago does not collect any identifiable information about the end-user (such as name, email address, etc.) except when you specifically and knowingly provide such information. Divago registers information such as missing URL, browser type, alternative choose, and IP address with each response. That information is used to improve the system and to provide more relevant responses to end-users.
3) System Response
The links displayed as alternatives in the system's response are automatically and objectively produced by the system and Divago cannot and does not screen the links before including them in the alternatives. These links once selected may send their own cookies to users, collect data, or solicit personal information.
The system's alternatives may include links to sites that some people find objectionable, inappropriate, or offensive. Divago cannot guarantee that the list of alternatives produced will not include unintended or objectionable content and assume no responsibility for the content of any site included in any System's response.
3) Liability
(a) The end-user acknowledge that the System has not been prepared to meet his/her requirements and agree that the Licensor does not warrant that the operation of the software will be uninterrupted or error-free or that defects in the software will be corrected.
(b) The end-user shall use the software at his/her own risk and in no event shall the Licensor be liable to the end-user for any loss or damage of any kind arising from his/her use of or inability to use the software or from faults or defects whether caused by negligence or otherwise.
(c) The System is provided to the end-user "As Is," without any warranty of any kind. Without limiting the foregoing, licensor makes no warranties, express or implied, by operation of law or otherwise, and to the fullest extent permitted by law hereby expressly disclaims all warranties including without limitation any implied warranties of title, non-infringement, merchantability, satisfactory quality, acceptable quality or fitness for intended use or any implied warranties arising out of the course of performance, course of dealing, usage or trade.
(d) The licensor shall not be liable for loss of profits or contracts or any indirect, special, consequential, incidental or punitive damages whether arising from negligence, breach of contract or howsoever including damages resulting from loss of data.
The end-user may not install this software into any computer or copy it unless s/he agrees to the terms of this Licence. If s/he does not accept the terms of this Licence, s/he should not proceed any further. The end-user agree to the terms of this Licence when s/he clicks "Yes - I Agree" below.
